Top Lawyer blasts Hague Tribunal as a Joke

The Hague Tribunal verdict is shameful, not founded on evidence, and when delivered the judges avoided all questions they were obliged to accept. The court deserves contempt and if I had the power, I would close it at once, says lawyer Nathan Dershowitz following the Hague verdict to reject the appeal of Johan Tarculovski regarding the 12-year prison sentence over case "Ljuboten".

"The verdict is a disgrace. I am appalled from what I have read. The court passed a judgment not founded on any evidence. The Appellate Court accepted what was said. They avoided all major questions they were obliged to take into consideration. This is not a judgment passed by one with at least some self-respect and respect to the principles of law. One can only despise them and ask how can they be called a court of justice. They aren't. If I had the power, I would close the tribunal in a minute", said Tarculovski's lawyer.

Asked if there is a chance for Tarculovski to serve the remainder of the prison sentence in Macedonia, Dershowitz hopes the Tribunal would allow this.

"Every day spent in this prison is a disgrace. He should have been released, because the Tribunal had to look at the case very seriously and pass serious judgments. If some other country did the same as Macedonia and some officer did the same as Johan, there is no way he would be imprisoned. America does this every single day, sending planes to bomb and kill, but no one has accused it. They would not do it to Russia or China too, but they did it to Macedonia, because it is a small country", said Dershowitz.

Antonio Apostolski, who was also part of Tarculovski's defense team, stressed they would ask the Security Council for Tarculovski to serve the prison sentence in his homeland.

"Their decision can make this possible", added Apostolski, announcing they would ask for the sentence reduction after Tarculovski serves two-thirds of it.

The Hague Tribunal Appeals Chamber dismissed Wednesday the appeal of Johan Tarculovski regarding the 12-year prison sentence over case "Ljuboten".

The judges rejected the defense arguments regarding his responsibility in the Ljuboten police operation, saying it was legitimate and in line with international law, thus not considered a war crime. According to the defense, Ljuboten is a case without a direct proof of a war crime, has a local character and should be processed in Macedonia.

The court also dismissed the appeal of the prosecution regarding the acquittal of former Minister of Interior Ljube Boskoski.

Today's Court judgments are final.

Tarculovski and Boskoski were the only Macedonian nationals indicted by the Hague Tribunal for the 2001 conflict in the country.

The Trial Chamber found Tarculovski guilty of crimes committed in Ljuboten on July 12, 2008 and sentenced him to 12 years imprisonment, whereas Boskoski was acquitted.

Johan Tarculovski has been in the Scheveningen prison since March 16, 2005 following his extradition from Macedonia which was a disgrace in itself.

One thing we can take from this process is that there apparently was a war in 2001. For this to be a war crime, there must have been a war. The enemy still exists today with the same aims as before. Finish the war Macedonians.

For the lawyer to make such a damning statement such as this, something is obviously horrifyingly wrong with the system in Hague. I believe Tarculovski will eventually be compensated.

Too right Risto i was almost in tears, Johan's children will grow up without a father because the court convicted him of hearsay. There was never any evidence to convict him of a charge so they made one up anyways its appalling. Like the lady from Sitel said its not Johan who is convicted its our whole country mameto nivno. The way they work is that there is always a scapegoat and somebody has to take the fall for something, well our country was attacked what were we suppose to do?

I just saw a report on Sitel, in which Tarculovski had sent a letter that said something along the lines of "it was patriotic to fight for Macedonia 10 years ago. It is patriotic now to support Macedonia going forward". Does anybody have a link to this letter so we can confirm what was actually said?

Јохан во Германија, писмото од Хаг, 19.07.2011

Јохан Тарчуловски е во затвор во Германија, а на денеска објавеното негово писмо пишува дека е испратено од Хаг. Државната новинска агенција МИА денеска објави писмо од хашкиот осуденик Јохан Тарчуловски во кое тој дава свое видување за хашките случаи.

„Премиере Груевски, покажи доблест да се затвори ова последно поглавје од 2001 година. Разговарајте за тие Хашки случаи, проверете ги законите, и ако има можност решете го тоа прашање еднаш засекогаш, запрете ги и оставете ги во историјата“, пишува Тарчуловски.

Во факсимилот од писмото, објавен на МИА, стои „Јохан Тарчуловски, син на Македонија, затвор Хаг“.

Сепак, токму МИА, на 7 јули годинава објави дека Тарчуловски, од затворот во Хаг е префрлен во германскиот затвор Диез.

„Сопругата на Јохан, Соња Тарчуловска за МИА потврди дека тој утрово е префрлен во затворот во Германија“, објави државната новинска агенција на 7 јули годинава.

МИА, објавувајќи го писмото, наведува дека до нив го доставило Здружението за поддршка на Јохан Тарчуловски.

„Писмото, како што информира Здружението, ќе биде доставено и до претседателот на Собранието Трајко Вељаноски“, наведува МИА, но не дава други детали – кога е испратено и од каде.

Собранието вечерва со 63 гласа „за“ и 29 „против“ во рамки на продолжението на 4. седница го усвои автентичното толкување на член 1 од Законот за амнестија. Опозицијата жестоко се противеше на донесувањето на законот.

So it seems that the parliament voted in favour of the amnesty law 63 for -29 against. And SDS is against the amnesty law, which is probably only a political stunt on their behalf. If the amnesty law is passed, does that mean that Johan Tarculovski will be released (in addition to the terrorists being off the hook)? Is that the purpose of his letter? Or is this just another appeal by Johan for more support by the government? Would appreciate if anybody can clarify and elaborate.
